General Introduction
The Fly High Driving Academy [FHDA] Terms and Conditions are based on the industry standard ‘Code of Practice for Approved Driving Instructors’ [ADI’s] and are applicable to clients who are undertaking practical in – car driving courses with the Fly High Driving Academy [FHDA] and delivered by a FHDA Approved Driving Instructor [ADI].
Please note that FHDA clients who have purchased our Complete Learner Driver Video Course Package should refer to the relevant Terms and Conditions of Use located on the thinkific learning platform via https://flyhighdrivingacademy.thinkific.com
The FHDA offers strategic advice to our enrolled driving students relating to passing the Theory & Hazard Perception tests, intended to supplement not replace the DVSA app resource that is fundamentally sufficient for this purpose.
The FHDA does not offer in – car individual one or two hour driving lessons. The FHDA offers learner drivers, in – car: Assessment / Troubleshooting / Training full days (with or without free access to preparation videos – depending on the mode of booking); complete follow on intensive or semi – intensive or ultra – intensive driving courses delivered over an agreed schedule; & practical driving test half day and ultra intensive bookings. We further offer learner drivers, in – car: Troubleshooting Packages that follow on from our Complete Learner Driver Video Course Package – only available after the Complete Learner Driver Video Course Package has been purchased and independently used in its entirety.
The FHDA also offers refresher driving courses to full car licence holders. We also offer professional development training and CPD courses for PDI’s and ADI’s both in – car and online.
Due to the UK practical test booking changes that took place in 2026 the FHDA can not book or manage your practical driving tests. It will be the exclusive responsibility of the individual driving student to book and manage such test bookings. The FHDA will only advise FHDS driving students as to appropriate dates and booking strategies as required and as part of our professional services.

Changes we can always make

Changes we can only make if we give you notice and an option to terminate. We can also make the following types of change to the service or these terms, but if we do so we’ll notify you and you can then contact us to end the contract before the change takes effect and receive a refund for any services you’ve paid for in advance, but not received.
Where to find information about us and our services
You [the client] can find everything you [the client] need to know about the Fly High Driving Academy and our services on our website www.flyhighdriving.academy before you book.
When you book directly through the FHDA, the Abridged Terms & Conditions, relating to our cancellation policy, are contained within the invoice and receipt that are emailed to you [the client] prior to and after you [the client] have made the agreed payment in full. The full Terms & Conditions are also available on the aforementioned website prior to booking and at any time after booking and in hard copy form for you to read on the first day of the booked course.
When you buy services from us
You [the client] are agreeing to provide the personal information contained on your [the clients] provisional or other driving licence for the legitimate purpose of checking your [the clients] licence data as required and as per the DVSA Licence Checking Protocols, as required, and also for the purpose of generating a payment invoice and receipt both of which will be sent to you [the client] via email attachment [Direct booking with the FHDA only]. Your [the client] data will be retained for legitimate purposes only including required tax record keeping.
You [the client] are also required to fully complete, date and sign the ‘Fly High Driving Academy Client Details & Record of Progress’ hard copy form at the start of any driving course. Such hard copy data will be retained by us for legitimate tax record purposes and emergency service personnel use should the need arise when in the car.
You [the client] are also agreeing to abide by appropriate behaviours in the car and throughout the course that are conducive with both a positive learning experience and your [the clients] own health and safety and that of any / all occupants of car and other road users and members of the general public.
Sometimes we refuse and / or withdraw our offer of service
Should you be unable or unwilling to provide the required information prior to the commencement of a driving course or if the information that you provide is inaccurate in ways that compromises the delivery of a professional and / or legal driving course, then service will be refused without refund or prejudice and without recourse to any legal remedy whatsoever.
At the professional discretion of the in – car Fly High Driving Academy instructor delivering the course, no service will be provided prior to you fully completing the required in – car documentation (including but not limited to an appropriate and current driving license) and / or if you are unable and / or unwilling to tick the three boxes contained within the ‘Fly High Driving Academy Client Details & Record of Progress’ hard copy form and without refund or prejudice and recourse to any legal remedy whatsoever.
If at any time during the in – car driving course you behave in a way that is not conducive with a positive learning experience and / or compromises your own health and safety and / or that of any occupants of car and other road users and members of the general public then the service will be cancelled without refund or prejudice and without recourse to any legal remedy whatsoever. The decision by the in – car Fly High Driving Academy instructor delivering the course as to continue with or cancel the driving course based on the above is final and without refund or prejudice and without recourse to any legal remedy whatsoever.
Driving fit
The FHDA reserves the right to withhold the use of the FHDA instruction vehicle for any previously agreed use if in the professional opinion of the attending FHDA ADI you [the client] are: Medically unfit by your [the clients] admission or the reasonable conclusion of the attending FHDA ADI (including eyesight that does not allow you [the client] to accurately read a car number plate at the prescribed distance, as tested at the time); Under the influence of drugs or alcohol, as acknowledged by you [the client] or the reasonable conclusion of the attending FHDA ADI; Not properly licensed to drive or unable to produce the relevant driving licence; OR for any other reason as reasonably determined by the attending FHDA ADI as being UNSAFE TO DRIVE at that point in time.
Should you [the client] be deemed unsafe to drive
Should the use of the instruction vehicle be withheld in the interests of public safety and / or the safety of the occupants of the car and / or any breaches of the above criteria relating to your [the clients] fitness to drive, any loss of fee for any practical driving course or test or other booking with the FHDA will be your [the clients] sole responsibility and no refund of fees paid by you [the client] to the FHDA nor compensation for loss of time within a practical driving course or the loss of the DVSA driving test fee will be paid to you [the client] without refund or prejudice and without recourse to any legal remedy whatsoever.
We are not responsible for delays outside of our control
If our supply of service is delayed by events outside of our control, we will contact you as soon as possible to let you [the client] know and do what we can to reduce the delay. As long as we do this, we will not compensate you for the delay. Instead we will either extend the duration of the driving course on that day or reschedule a mutually convenient alternative day as appropriate. If this is not possible you [the client] will receive a refund for any services that you [the client] have paid for in advance and not received on a pro rata basis. Where a refund or reschedule is not possible, based on the above, this will be without prejudice and without recourse to any legal remedy whatsoever.
Cancellation terms and legal ‘Cooling Off Period’
With regard to any in – car driving course that you [the client] have booked directly with the FHDA over the telephone or by email [with subsequent text agreement and invoice payment in full] you [the client] must give the FHDA at least 14 days notice of cancellation in writing [via letter or email] prior to the agreed start date to be eligible for a full refund minus a £75 admin charge. A rescheduled booking may be possible by mutual agreement with at least 14 days notice in writing [via letter or email] *.
With regard to any in – car driving course that you [the client] have booked directly with the FHDA over the telephone or by email [with subsequent text agreement and invoice payment in full] you [the client] will not be eligible for any refund if you [the client] cancel without giving the FHDA at least 14 days notice of cancellation in writing [via letter or email] prior to the agreed start date regardless of the reason. There will also be no rescheduling whatsoever within 14 days prior to the agreed start date regardless of the reason *.
With regard to a FHDA assessment / troubleshooting / training day that you [the client] have booked and paid for online the course fee paid will not be refunded nor will the course day be rescheduled under any circumstances whatsoever **.
* Please note that upon booking any driving course directly with the FHDA, a specific instructor will be exclusively allocated to you [the client] in order to deliver the agreed course on the specific date and time that you [the client] have booked. Therefore, any cancellation by you [the client] constitutes a ‘Full Day Capacity Cancellation’ and exempts the FHDA from providing a legal cooling off period. However, the FHDA cancellation terms as outlined above will still apply.
** Please note that upon booking and paying for a FHDA assessment/ troubleshooting/ training day online, a specific instructor will be exclusively allocated to you [the client] in order to deliver the agreed course on the specific date and time that you [the client] have booked. Therefore, any cancellation by you [the client] constitutes a ‘Full Day Capacity Cancellation’ and exempts the FHDA from providing a legal cooling off period. As you [the client] will be granted immediate access to the digital resources of the course, i.e. the eight FHDA assessment / troubleshooting / training day preparation videos, the course will be deemed to have started and therefore there will be no refund nor rescheduling.
In summary please note that in accordance with the Consumer Contracts Regulations 2013, the FHDA bookings will always be for a specific date and time as well as for the exclusive full day capacity of the allocated instructor. Therefore, your [the client] right to cancel under a 14-day cooling-off period does not apply to any FHDA booking. This is a legal exemption.
Where a refund or reschedule is not possible, based on the above, this will be without prejudice and without recourse to any legal remedy whatsoever.
How to claim a legitimate refund or reschedule from the FHDA
To claim a legitimate refund from the FHDA, as per the above, you [the client] need to contact us in writing [by letter or email]. Please include your [the clients] name, driving course details (including the agreed dates) and your [the clients] bank details. We will only refund you [the client] according to the above terms. We aim to do so within 14 days of receiving your [the clients] application as applicable. We do charge an admin fee of £75 for a legitimate cancellation as per the above. We will usually arrange to reschedule any driving course day by mutual agreement but only if the application gives at least 14 days notice of the agreed start date. Any application for a refund or reschedule that does not give at least 14 days notice of the agreed start date will not be considered under any circumstances whatsoever. Also, once a driving course has started there will be no refund or reschedule under any circumstances whatsoever.
We do not compensate you [the client] for all losses caused by us or our services
We are responsible for losses you [the client] suffer caused by us breaking this contract unless the loss is:
Provisional Car Driving Licence
All Fly High Driving Academy in – car driving clients are required to independently apply and pay for a UK provisional car driving licence [unless other licences are applicable] prior to attending any FHDA in – car assessment / troubleshooting / training days or intensive driving or other courses: This is not the responsibility of the Fly High Driving Academy. You [the client] are required to bring and show your UK provisional or full or other appropriate car driving licence at the start of the assessment / troubleshooting / training or other course day.
No in – car driving instruction shall proceed without this and no refund will be given for any time lost or any other reason as a result of your failure to so do. Nor will there be any reschedule without further booking and payment.
Where a refund is not possible, based on the above, this will be without prejudice and recourse to any legal remedy whatsoever.
Car Theory Tests
All Fly High Driving Academy driving clients are required to independently book, pay for, study for and pass the car theory test ideally prior to their assessment day or intensive driving or other course where possible – unless a car theory test pass is not required to be able to book a practical test.
The resources to pass the car theory test are easily accessible via the DVSA app and elsewhere: They are well suited for independent study and do not require ADI input from the FHDA. Although relevant driving theory will be reinforced throughout the in – car driving tuition, as applicable
It is desirable that you [the client] do pass the car theory test, as applicable, ideally before the assessment / troubleshooting / training day or the first day of the intensive or other driving course as this allows a mutually convenient practical driving test to be booked by you [the client] at the end of the first practical driving assessment where applicable. This may not necessarily apply to the FHDA trouble shooting courses as these do not routinely include taking the practical driving test in a FHDA vehicle.
Independently passing the theory test in advance also ensures a degree of familiarity with road signs and the rules of the road before getting behind the wheel. Without this advance familiarity, valuable attentional resource will be used at the expense of the development of the required psycho-motor and associated muscle memory and the procedural driving and strategic learning.
It is most certainly in the interests of yourself [the client] not to delay passing the car theory test, as applicable, as to do so may well significantly delay being able to take the practical driving test at the appropriate time for the reasons given above.
If you [the client] are at any point prior to passing the practical driving test
The best way to proceed with the FHDA or any other chosen route is to first purchase our Complete Learner Driver Video Course Package located on the Thinkific learning platform via https://flyhighdrivingacademy.thinkific.com
Once you [the client] have worked through these online resources, as directed on the above Thinkific page, you [the client] become eligible to take one of our in – car trouble shooting driving courses or you are much better prepared for any FHDA driving course. Alternatively, you [the client] can book a FHDA, in – car assessment / troubleshooting / training day that includes an introduction to test standard driving and selective use of the video course package for your first hand inspection and purchase at that point.
As applies to all FHDA in – car course days, in – car assessment / troubleshooting / training day will start and finish at Ipswich train station. All FHDA in – car driving course full days start at 10:00 am and finish at 04:00 pm (unless a time extension or other times are mutually agreed). The scheduled driving course full day includes 60 minutes of breaks. Working breaks that utilise video and other resources may be utilised as part of the assigned driving course hours as required.
All FHDA in – car driving course half days run from either 10:00 am to 01:00 pm or 02:00 pm to 05:00 pm (or other times if mutually agreed). The scheduled driving course half day includes 30 minutes of breaks. Working breaks that utilise video and other resources may be utilised as part of the assigned driving course hours as required. There are no time extensions on scheduled course half day courses.
Booking a practical driving test
The total FHDA course fee does not include the DVSA practical driving test fee. You [the client] will need to additionally pay the DVSA practical driving test fee. The DVSA practical driving test fee is not the same as the FHDA practical driving test booking. FHDA practical driving test booking will be scheduled for three hours around the test time that you have booked – allowing for up to 57 minutes for the test itself and 30 minutes to get back to Ipswich train station. The fee paid to the FHDA includes the car hire for the duration of the test.
Due to the 2026 practical driving test booking changes you [the client] will be solely responsible for booking your [the client] practical driving test as and when the FHDA instructor informs you [the client] that you are ready to do so. You should, ideally, not book the practical without the express agreement of the the FHDA instructor who is working with you [the client]. Should you [the client] have an existing practical test booking in place you [the client] will be required to have a full FHDA assessment / troubleshooting / training day in order to assess your readiness for test and the need of any further driving instruction as required. Remember that, no one other than yourself [the client] will be legally permitted to book or manage the practical test for you and any test booking changes or cancellations are subject to the new rules as explained on the DVSA .GOV.UK website. The FHDA will support your [the client] navigation of the practical driving test booking without the need to swap tests with other test candidates via the diligent use of the DVSA .GOV.UK website directly. The FHDA only endorses you [the client] and no one else booking your [the client] practical driving test via the online portal on the DVSA .GOV.UK website to avoid the potential legal, ethical and logistical issues of doing otherwise.
Your [the client’s] readiness to take the practical driving test will be assessed by the FHDA instructor based on their experience of working with you [the client] in the car and any ‘Clipboard Experiences’ and /or mock tests as appropriate. The FHDA instructor’s decision as to your [the client] test readiness is final and you [the client] will not be permitted to take the practical driving test in a FHDA instruction vehicle unless you [the client] are judged to be ready exclusively by your [the client] FHDA instructor. There are other options available to you [the client], e.g. taking the test in your [the clients] own car, that will be discussed with you [the client] during the assessment / troubleshooting / training day as applicable.
The important thing is to work towards getting to practical driving test standard within the appropriate intensive or semi – intensive driving course wherever possible and to be prepared to book more follow on days as required. Once you [the client] have reached an appropriate driving test standard, a last minute cancellation for the Ipswich practical driving test centre can be booked by you [the client] for either the 07:13 am or 08:10 am tests unless otherwise agreed. So long as the FHDA ADI confirms that you [the client] are indeed ready to take the practical driving test with a good chance of passing, then it is usually possible to accommodate such last minute early morning test bookings. This and achieving a pass can not, of course, be guaranteed. However, every reasonable effort will be made to facilitate your [the client] success.
Please note that the FHDA only hires out their instruction vehicles for Ipswich tests unless otherwise agreed. A practical test booking is usually for a minimum of one half day and includes the car hire fee and time to take the test in a FHDA vehicle. However, there are ultra – intensive test booking options available as required. These are for a total of 4.5 hours and include a ‘One Chance’ mock on the test day and taking the test should you [the client] pass the mock. If you [the client] do not pass the ‘One Chance’ mock you [the client] will not be permitted to take the booked test and the remainder of the scheduled 4.5 hours will be used as further driving instruction time as required.
Any suitable practical driving test retake and additional follow on course days will be negotiated with, booked and paid for by you [the client] as applicable.
Practical Driving Assessment / Troubleshooting / Training Day
Please note that the FHDA assessment / troubleshooting / training day is obligatory and all FHDA intensive and semi – intensive and other practical driving courses will only commence after the in – car assessment has taken place.
All FHDA driving courses (including the assessment / troubleshooting / training day) start and finish at Ipswich train station in order to maximise the effectiveness of the course hours (unless otherwise agreed).
Please note that when you [the client] book directly with the FHDA, as opposed to booking online, the preparation videos will not be accessible prior to the assessment / troubleshooting / training day unless otherwise informed.
Practical Driving Assessment / Troubleshooting / Training Day when Booked Directly with the FHDA
In order to book an assessment / troubleshooting / training day or other in – car course directly with the FHDA you [the client] will be required to both confirm your availability and agreement by text and email a photo of your [the client’s] provisional or other driving licence to the FHDA email address given. This will provide the FHDA with the required information for an invoice to be generated and emailed back to you [the client] for advanced payment via bank transfer in order to secure the booking. Once the funds have been received and cleared a receipt will be issued and emailed to you [the client].
Practical Driving Assessment / Troubleshooting / Training Day when Booked ONLINE
The assessment / troubleshooting / training day can also be booked online and this will give you [the client] additional, exclusive access to eight preparation videos, designed to be independently viewed by you [the client] prior to the assessment / troubleshooting / training day. This effectively starts the course as soon as you book.
In order to book an assessment / troubleshooting / training day online you [the client] will be required to access the course scheduler tool via a direct link or from the Fly High Driving Academy Website and select the date and time that you require [as available], complete the sign up form in full and make the payment as instructed. After successfully booking your initial driving day you will receive a receipt, further instructions on where to meet and what to bring, etc. Furthermore you will be granted access to a private video playlist with the eight preparation videos to enhance your experience in the car on the day that you have booked. We recommend you make time to watch these videos ahead of your session as applicable to your stage of learning to drive. The videos are private property and are not intended to be shared privately or publicly in any way, shape or form with anyone else.
The Purpose of the Practical Driving Assessment / Troubleshooting / Training Day
The purpose of the assessment / troubleshooting / training day, regardless of whether you [the client] book directly with the FHDA or online, is to meaningfully identify the driving topics you [the client] have previously covered, how well they have been taught and your [the client] current level of your understanding, driving awareness, skills and competencies if any. Even if you [the client] are starting from scratch, the day is also an opportunity to gauge how receptive you [the client] are to the strategic approach exclusively offered by the FHDA. The troubleshooting element of the assessment / troubleshooting / training day will identify the key aspects of your driving that need to be focussed on within a recommended follow on driving course. The troubleshooting element applies even if you have never been behind the wheel before as there will be time to introduce, explain, demonstrate and for you [the client] to try appropriate driving skills and procedures for yourself during the day. Competencies that you [the client] need to work on can thereby be identified and worked on within this initial day. Throughout and / or at the end of the day, the course coverage, your progress and how to go forward will be discussed as required. Wherever possible, the follow on course options will be either texted or emailed to you straight after the course.
After the Assessment / Troubleshooting / Training Day
Should you [the client] wish to continue with the FHDA after the assessment / troubleshooting / training day you [the client] will need to indicate which of the options offered you require. Mutually convenient dates will then need to be agreed upon and a corresponding invoice, reflecting the agreed follow on driving course details and containing the FHDA bank details, will be generated. The invoice will be emailed to you [the client]. The fee for the agreed follow on course will need to be paid in full via bank transfer, in advance and without undue delay to secure the booking. A receipt will be emailed to you [the client] once the funds have been received and cleared.
In – car documentation completion
You [the client] are required to fully complete the front cover of the FHDA “Client Details & Record of Progress” Leaflet at the start of the first FHDA driving tuition day. You [the client] must print, sign and date the aforementioned leaflet thereby accepting these terms unconditionally and formally verifying the required declarations, prior to the commencement of any driving tuition. This will normally take place in the car and in the presence of your FHDA instructor.
Should the assessment / troubleshooting / training day or practical driving course not be able to go ahead due to these requirements not being met prior to the start of FHDA practical driving tuition our cancellation terms will apply.
Valid Driving License
A valid driving license must be produced on first meeting with a FHDA ADI and be available for regular instructor inspection. You [the client] must inform the FHDA if you [the client] receive any endorsements on your driving licence during the time that you [the client] are receiving FHDA driving tuition or prior to your [the client’s] test date.
Any disabilities or disqualifications that you [the client] have or come to light before starting or that develop / you [the client] acquire during the FHDA driving course that might affect your [the client’s] ability to drive must also be disclosed to the FHDA before the start of the course, if pre – existing, or when they develop / are acquired: Should any FHDA driving course be cancelled by the FHDA due to such disclosures / developments or a failure to verify the disability or licence issue as appropriate, all driving tuition will be cancelled and no refund or reschedule whatsoever will be due. Where a refund or reschedule is not possible, based on the above, this will be without prejudice and without recourse to any legal remedy whatsoever.
Driving course fees & cancellation terms for all driving courses booked directly with the FHDA
All practical in – car driving course fees are due in full and in advance in order to secure the previously agreed booking.
Unless you [the client] have booked online, an invoice containing the previously agreed driving course dates and the FHDA business bank account details will be sent via email attachment.
No practical driving assessment day or course will commence until the agreed financial payment has been made in full. Should the booking be cancelled by you [the client], a full refund (minus £75 admin charge) will only be due if a minimum of 14 days notice of cancellation prior to the agreed practical in – car assessment or driving course start date is given. A reschedule may be possible under these circumstances. However, no refund or reschedule will be due should you [the client] cancel within 14 days of the agreed start date. Where a refund or reschedule is not possible, based on the above, this will be without prejudice and without recourse to any legal remedy whatsoever.
Fee payment for all driving courses booked directly with the FHDA
All practical in – car driving assessments and practical driving course fees require verified bank transfers before any driving tuition will be given. Cash and cheques are not accepted.
Rescheduling of agreed tuition hours by FHDA
In the interests of all clients, there may be a need to reschedule your [the clients] agreed driving tuition hours in order to accommodate a last minute test booking for another client. Under these circumstances mutually reschedule will need to be negotiated as a refund to you [the client] is not possible without prejudice and recourse to any legal remedy whatsoever.
Driving Vehicles Standards Agency [DVSA] Postponement or cancellation of a practical driving test
A statutory period of notice is required under government regulations for the postponement or cancellation of a practical driving test by the DVSA. Should the DVSA cancel a practical driving test you [the student] should claim for the cost of a retest and any required follow on FHDA course days from the DVSA. The FHDA cannot be held responsible for any postponement or cancellation of a practical driving test by DVSA: The FHDA will not financially compensate you [the student] under such circumstances and this is without prejudice and without recourse to any legal remedy whatsoever.
Complaints against the FHDA
If you [the student] are dissatisfied with the service provided by the FHDA, you [the client] can submit a written [letter or email] statement to the FHDA no later than 14 days after the end of your driving course, outlining the issue in detail and in order to arrange an informal, mediating discussion between you [the student] and the FHDA. The purpose of this would be to clarify the relevant professional context and instruction given. Unless there is good, justified and substantiated course to the contrary, a refund or reschedule will not be applicable and this will be without prejudice and without recourse to any legal remedy whatsoever.
Should you [the client] still feel dissatisfied with the outcome of the above you [the client] can contact the DVSA in writing within 14 days of the end of the FHDA practical driving course in order to seek further support and guidance as required.
Driving tuition start & course timings
Unless otherwise agreed and under exceptional circumstances, all practical driving course days will start from and finish at Ipswich train station drop off car park.
In your [the client] own interests, you [the client] are advised to be punctual for all agreed start times. The FHDA ADI will wait up to 15 minutes unless otherwise agreed due to an unforeseen client delay. A reciprocal waiting time or more in exceptional circumstances may become necessary for the arrival of the FHDA ADI delayed for some unavoidable reason.
The affected practical driving course day will commence from the appointed time or the time of the FHDA ADI’s arrival should that be later and then finish later to compensate as appropriate.
The FHDA course timings will follow the agreed schedule where possible. However, these timings will be flexibly adhered to in the interests of and in negotiation with you [the client].
Insurance and road worthy condition of FHDA vehicles
All FHDA instruction vehicles will be fully insured for driving tuition and taking the DVSA practical driving test and be in a suitably road worthy condition. The certificate of insurance will be available for inspection upon request to the attending FHDA ADI and with notice.
Practical driving test documentation
You [the client] are reminded that when you [the client] take the DVSA practical driving test you [the client] must bring the required documents: This is not the responsibility of the FHDA. Failure to comply with this requirement will mean the examiner will have to cancel your [the client’s] test: This will also be the case should you [the client] fail the eyesight test at the start of the DVSA practical driving test. You [the client] will then forfeit the DVSA practical driving test fee and will have to apply and pay for a new test booking. No refunds for DVSA test fees or FHDA test day bookings whatsoever will be paid to you [the client] by the FHDA. This is without prejudice and without recourse to any legal remedy whatsoever.
Legal liability
No liability of any kind will be accepted by the FHDA for the loss of or damage to any property belonging to or in the possession of you [the client] during any FHDA practical driving instruction or test or during any of the agreed practical driving course breaks.
You [the client] should be aware that the attending FHDA ADI’s primary professional imperative is to ensure and promote road safety and in doing so he / she will have to issue instructions which you [the client] must carry out without undue hesitation or discussion at the time. All incidents and driving situations can be discussed later, at the side of the road, as required.
The attending FHDA ADI will make every effort to train you [the client] to the highest standard but can in no way be held responsible or liable for any driving errors you [the client] make whilst behind the wheel of a FHDA instructor vehicle or when in any other vehicle and unaccompanied by your FHDA ADI outside of the FHDA practical driving course and / or at any time before or after a DVSA practical driving test pass.
You [the client] will be responsible and liable for any damage caused by you [the client] to any vehicle or property or person while driving under FHDA instruction [including the FHDA instruction vehicle and / or property] and when unaccompanied by your FHDA ADI outside of the FHDA practical driving tuition context. Under such circumstances, you [the client] will be liable to pay the full cost of repair and / or damages incurred and this will be without prejudice and without recourse to any legal remedy whatsoever.
At the complete discretion of the attending FHDA ADI, an insurance claim may be made on your [the client’s] behalf and in which case you [the client] will be liable for the full cost of the insurance excess premium due and this will be without prejudice and without recourse to any legal remedy whatsoever.
Payment in full of the aforementioned costs by you [the client] must be made and before any FHDA driving tuition can continue. This is without prejudice and without recourse to any legal remedy whatsoever.
Should you [the client] be caught speeding or any other unsafe behaviour while driving under FHDA ADI instruction or on test in a FHDA vehicle or when driving in another vehicle you [the client] will be responsible for the payment in full of any fines imposed: Should you [the client] be offered a speed awareness course in order to avoid fines and driving penalty points then you [the client] must bear the full cost of this. This is without prejudice and without recourse to any legal remedy whatsoever.
Terms and conditions as applied to driving agency Students
All of the above FHDA terms and conditions will apply to you [the client] if you have initially booked your [the client] driving course through a third party driving agency except the requirement to have a FHDA assessment / troubleshooting / training day. The driving course hours that you have booked through the third party driving agency will be delivered by the FHDA ADI allocated to you.
The allocated course hours include the car hire for an appropriate practical driving test should you [the client] be at test standard by the end of the penultimate day of the agreed driving course and at the discretion and professional judgment of the FHDA ADI allocated to you. Such a decision will be final even if a test booking is in place for the last day of the course. Should you [the client] not be at driving test standard by the end of the penultimate day of the agreed driving course the course hours will be completed as scheduled.
You [the client] may choose to continue with the FHDA ADI that you have worked with via a direct booking with the FHDA not the agency that you [the client] booked through. The above FHDA terms and conditions will apply but without the need to book a FHDA assessment / troubleshooting / training day.
